The rift between the Centre and the Supreme Court has deepened, taking a more aggressive turn. BJP MP Nishikant Dubey has launched a scathing attack on the apex court, accusing it of promoting “anarchy” and “inciting religious wars”—a serious escalation in the ongoing tensions between the executive and judiciary.
Dubey’s remarks follow Vice president Dhankhar’s “Nuclear missile” comment on Judiciary
Dubey’s remarks come shortly after Vice President Jagdeep Dhankhar criticized the Supreme Court, saying “Article 142 has become a nuclear missile against democratic forces, available to the judiciary 24×7.” His comments were in response to a recent Supreme Court judgment that effectively set a timeline for the President and Governors to assent to Bills passed by legislatures.
Questioning the judiciary’s authority, Dubey asked, “How can you direct the appointing authority? The President appoints the Chief Justice of India. Parliament makes the laws of this country. Now, the judiciary wants to dictate Parliament? Where is it written that the President must act within three months? This is a push towards anarchy. A detailed discussion will take place when Parliament is in session.”
The BJP leadership has yet to respond to Dubey’s controversial statements. His criticism intensified as he accused the Supreme Court of “inciting religious wars” and overstepping its constitutional limits. “If everything must go to the Supreme Court, why have Parliament and State Assemblies at all?” he asked, offering no evidence to support his allegations.
Dubey made his remarks while the Supreme Court was hearing petitions challenging the constitutionality of the Waqf (Amendment) Act, 2025. During the April 17 hearing, the Centre assured the Court that it would neither denotify any ‘Waqf-by-user’ properties nor appoint non-Muslim members to the Waqf Board. The Court had earlier indicated that it might consider staying certain provisions of the law, which petitioners argue violate constitutional rights such as equality and freedom of religion.

Congress reacts to Nishikant Dubey’s remarks
Congress leaders swiftly condemned Dubey’s remarks. MP Manickam Tagore called the comments defamatory and unacceptable. “This is a defamatory statement against the Supreme Court. Nishikant Dubey is continuously undermining democratic institutions. His comments were made outside Parliament, and I hope the judiciary takes note,” he said.
Congress MP Imran Masood echoed the criticism, calling the remarks “unfortunate” and an expression of unjustified frustration. “This isn’t the first time the Supreme Court has ruled against a majority government,” he said.

Supreme court’s recent judgement on Tamil Nadu Governor
The flare-up comes days after the Supreme Court deemed Tamil Nadu Governor RN Ravi’s decision to withhold assent to 10 bills as “illegal and arbitrary.” The Court set a three-month deadline for the President and Governors to clear bills passed for the second time by legislatures and suggested that the President refer constitutionally sensitive bills to the Court for guidance.
Dubey’s outburst parallels Vice President Dhankhar’s recent critique of the judiciary. Dhankhar questioned whether judges were overstepping by performing legislative and executive functions, saying, “We never bargained for democracy for this day… Judges will legislate, act as super-parliament, and face no accountability. That’s not how democracy was meant to function.”
