In a significant development, the West Bengal government, led by Chief Minister Mamata Banerjee, has announced its decision to pursue the death penalty for Sanjoy Roy, the convict in the RG Kar Medical College and Hospital rape and murder case. This decision comes in the wake of Roy being sentenced to life imprisonment by the Sealdah court.
Chief Minister Mamata Banerjee expressed her dissatisfaction with the life term awarded to Sanjay Roy, emphasizing that the heinous nature of the crime warrants capital punishment. In a post on X, Banerjee stated, “I strongly feel that it is a heinous crime that warrants capital punishment. We will plead for capital punishment of the convict at the High Court now.”
Banerjee’s comments followed the court’s decision, which found Roy guilty of the brutal rape and murder of a postgraduate trainee doctor at RG Kar Medical College and Hospital in Kolkata on August 9 of the previous year. Despite the life sentence, the Chief Minister maintained that the verdict fell short of justice.
Questioning the CBI’s Role
Addressing a gathering in Murshidabad, Mamata Banerjee criticized the Central Bureau of Investigation (CBI) for taking over the case, alleging that the agency’s intervention prevented the imposition of a death sentence. “I have been seeking the death sentence from day one. If the case had remained with us, we would have ensured the death penalty. The CBI intentionally took the case away from us. Such criminals deserve to be hanged,” she remarked.

Banerjee further questioned the CBI’s handling of the investigation, stating, “We don’t know how the probe was conducted. In many similar cases that were probed by the state police, the death penalty was ensured. I am not satisfied.”
Court’s Rationale for the Life Sentence
The Sealdah court, under the jurisdiction of Additional District and Sessions Judge Anirban Das, sentenced Sanjay Roy to life imprisonment until death. While delivering the verdict, Judge Das noted that the crime, although horrific, did not meet the “rarest of the rare” criteria necessary for awarding the death penalty.
