The Madhya Pradesh High Court recently made a significant ruling by quashing an FIR against a man accused by his wife of engaging in unnatural sex, citing that such conduct is not criminal when it occurs between a husband and his legally wedded wife.
In the order issued on Wednesday, Justice GS Ahluwalia of the Madhya Pradesh High Court emphasized that under current legal provisions, acts of unnatural sex between a husband and wife do not constitute an offence under Section 377 of the Indian Penal Code (IPC).
The High Court order reportedly said, “In view of the amended definition of ‘rape’ under Section 375 of IPC by which the insertion of penis in the anus of a woman has also been included in the definition of ‘rape’ and any sexual intercourse or sexual act by the husband with her wife not below the age of fifteen years is not a rape, then under these circumstances, absence of consent of wife for unnatural act loses its importance. Marital rape has not been recognised so far.”
The court’s ruling thereby determined that the allegations made against the husband were not legally sustainable, leading to the quashing of the FIR.
The Madhya Pradesh High Court decision underscores the existing legal framework in India, where marital rape is not specifically recognized as a criminal offence.
While acknowledging the serious nature of the complaint, the court’s interpretation of the law guided its conclusion that criminal prosecution against the husband in this context was unwarranted.
The order, uploaded on the Madhya Pradesh High Court website on Thursday, effectively nullifies the criminal proceedings initiated against the husband based on the complaint filed by his wife.
The ruling highlights a broader societal and legal debate surrounding marital relations and the rights of spouses within the framework of Indian law.
The decision of the Madhya Pradesh High Court in this case reflects the prevailing legal stance on marital rape and underscores the need for continued dialogue and advocacy on this sensitive issue within the context of evolving legal and societal norms.
