The parents of a 31-year-old doctor who was raped and murdered at Kolkata’s RG Kar Medical College and Hospital have stated that they do not wish for the death penalty for the convict, Sanjoy Roy. Their lawyer, Gargi Goswami, conveyed this stance to the Calcutta High Court during a hearing on Monday.
“Just because their daughter has lost her life does not mean the convict will also have to lose his life,” Goswami said, reflecting the family’s decision to avoid seeking capital punishment for the convicted man.
Appeals for Stricter Punishment
Despite the family’s position, the West Bengal government and the Central Bureau of Investigation (CBI) have appealed the Sealdah Sessions Court’s decision to sentence Sanjoy Roy to life imprisonment. Both parties are demanding the death penalty, arguing that the crime warrants the severest punishment under the law.

Advocate General Kishore Dutta, representing the West Bengal government, argued that the life imprisonment sentence was insufficient for a case of such gravity. Dutta pointed to legal provisions enabling state governments to appeal sentences deemed inadequate, citing recent amendments to criminal law.
“The amendment of Section 377 clarified that state governments, in addition to the central government, have the right to seek stricter sentences,” Dutta explained. He also requested the appointment of a Public Prosecutor to bolster the state’s case.
Court Observations
Justice Debangsu Basak, who is presiding over the case, acknowledged the dual appeals filed by the state government and the CBI. Both appeals aim to elevate the punishment from life imprisonment to the death penalty. While the judge recognized the state’s right to appeal under the federal structure, he emphasized the importance of coordinating such actions with the central government.
The High Court has reserved its judgment following Monday’s hearing, stating that it will review the arguments presented by all parties, including the victim’s family’s unique and compassionate perspective.
