New Delhi: Lieutenat Governor (LG) VK Saxena, in exercise of his powers vide section 4(2) of the DUSIB Act, 2010, has ordered the termination of services of two (02) non-official members of the Delhi Urban Shelter Improvement Board (DUSIB). The both were continuing as expert members, without having the requisite qualification of ‘experience and expertise’ in urban planning and slum matters, with immediate effect.
Bipin Kumar Rai has been performing the role of expert member for last nine years and Amrendra Kumar was appointed as non-official member in March 2022.
Both the members were drawing hefty remuneration in contravention of the law.
Saxena also ordered that a panel of fresh names for expert members who fulfil requisite qualifications may be submitted for his consideration in terms of the provisions of the DUSIB Act, 2010 read with Section 45D of the GNCTD (Amendment) Act, 2023 within a week.

He has also directed the Administrative Department to frame rules regarding service conditions of Board Members of DUSIB under Section 4(1) of the Act.
While Rai, who was a psychologist was continuing since 03.07.2015, with the final approval of the then LG vide notification dated 28.12.2016, Kumar was appointed vide notification dated 09.03.2022 with the approval of the then LG.
Kumar was appointed as non-official-member on the recommendation of the then Urban Development Minister, GNCTD. Earlier also, AK Gupta, who was appointed non-official Member on the recommendation of the then Urban Development Minister, and retired at the age of 72, did not fulfil the requisite qualification.
Gupta, who had retired as an Executive Engineer from DUSIB, was more than 65 years of age at the time of appointment and worked till the age of 72 years which was in contavention of government norms that provide that, no government employee should be allowed to work, even as consultant, beyond 65 years of age.
Instead of engaging both Rai and Gupta as expert members, DUSIB utilized them as the officials of Board and issued orders allocating them work as per its order dated 10.11.2015. While Rai was co-ordinating with and monitoring the functioning of agencies running/operating night shelters under overall supervision of Member (Administration), Gupta was in the management and operation of Jan Suvidha Complexes under overall supervision of Member (Engineering) and CEO.
Rai was initially engaged at the salary of Rs 70,000 per month which was increased to Rs 80,500 and further to Rs 98,520. This was in contravention of Section 52(2)(a) of the DUSIB Act as the members were appointed at consolidated remuneration and there was no provision of increment as applicable in the case of government employee.
Kumar was also engaged on the consolidated remuneration of Rs 98,250 besides Rs 25,000 as transport allowance and Rs 1500 per month as Telephone Allowance.
