New Delhi: The Delhi High Court on Thursday dismissed a Public Interest Litigation (PIL) petition that sought the removal of Arvind Kejriwal, the leader of the Aam Aadmi Party (AAP), from his position as the Chief Minister. The PIL was filed in light of Kejriwal’s recent arrest in a money laundering case linked to the excise policy.
A bench led by Acting Chief Justice Manmohan declined to delve into the merits of the case, stating that such matters were beyond the purview of judicial intervention.
“It is for the other wings of the government to examine in accordance with the law,” remarked the bench, which also included Justice Manmeet PS Arora.
During the proceedings, the court directed the counsel representing the petitioner, Surjit Singh Yadav, to demonstrate the legal impediments to Arvind Kejriwal continuing as Chief Minister. “There may be practical difficulties but that is something else. Where is the legal bar?” questioned the court.
Arvind Kejriwal, the national convener of the AAP, was arrested on March 21 and subsequently remanded to the custody of the Enforcement Directorate (ED) until March 28 by a Delhi court.
He faces allegations of being directly involved in a conspiracy related to the formulation of an excise policy that allegedly favoured specific individuals.
US once again reacts to Arvind Kejriwal’s arrest, freezing of Congress accounts
In response to India’s objection to the comments made by the State Department regarding the arrest of Delhi Chief Minister Arvind Kejriwal and the freezing of the main opposition party Congress’s account, the United States (US) has reiterated its stance on both issues.
US State Department Spokesperson Matthew Miller stated that the country is closely monitoring these developments. Speaking on Wednesday, Miller emphasized the importance of “fair, transparent, timely legal processes” in both cases. This statement was made in response to questions regarding India’s summoning of American diplomat Gloria Berbena, the US Acting Deputy Chief of Mission in New Delhi, on Wednesday concerning the remarks made on Kejriwal’s arrest in connection with the alleged Delhi Excise Policy scam case.
