The Delhi High Court on Thursday dismissed, for the third time, a plea seeking the removal of Arvind Kejriwal as Chief Minister following his arrest last month over corruption allegations. In a significant observation, the court, led by acting Chief Justice Manmohan, stated that “democracy should take its own course.”
Furthermore, the court refused to advise Delhi Lieutenant Governor V K Saxena on compelling Arvind Kejriwal to step down from his post, stating that it is not their place to offer guidance in such matters. The bench emphasized that the Lieutenant Governor will act in accordance with the law.
The petition, filed by the Hindu Sena, sought direction from the Lieutenant Governor to instruct Arvind Kejriwal to resign. However, the court urged the petitioner to prioritize national interests over personal issues and suggested raising the matter in another forum if they wished to persist.
Similar pleas were dismissed by the court last week and in January, with the court asserting that the removal of a sitting Chief Minister falls outside the scope of judicial interference. The court emphasized that such matters should be examined by other branches of the government according to the law.
Arvind Kejriwal was arrested on March 21 in connection with an alleged liquor policy scam, sparking controversy ahead of the elections. His lawyer, Abhishek Manu Singhvi, questioned the timing of the arrests, suggesting they were aimed at undermining the AAP before the elections. Kejriwal, known as the AAP’s main public figure, is currently in Delhi’s Tihar Jail until April 15.
After hearing arguments from Singhvi and the Enforcement Directorate, the High Court has reserved its verdict for later today.
