The West Bengal Assembly on Tuesday passed the Aparajita Woman and Child (West Bengal Criminal Laws Amendment) Bill, 2024, aimed at strengthening legal protections for women and children, particularly in cases of rape and sexual offences. The bill was introduced by state Law Minister Moloy Ghatak during a special two-day session of the Assembly, convened in response to the recent rape-murder of a junior doctor at Kar Medical College and Hospital.

Key Provisions of Aparajita Bill

  1. Death Penalty for Severe Cases

The Aparajita Woman and Child Bill 2024 introduces the death penalty for individuals convicted of rape if the crime results in the victim’s death or leaves her in a vegetative state.

  1. Amendments to Existing Laws

The bill proposes amendments to the Bharatiya Nyaya Sanhita 2023, Bharatiya Nagarik Suraksha Sanhita 2023, and the Protection of Children from Sexual Offences Act 2012 (POCSO). These amendments aim to enhance punishments and expedite investigations and trials of sexual offences against women and children.

  1. Time-bound Investigations

The Aparajita Woman and Child Bill 2024 mandates that investigations into rape cases be completed within 21 days, significantly reducing the previous two-month deadline.

  1. Fast-Track Courts and Special Task Force

The bill calls for the establishment of fast-track courts specifically for rape cases, and the creation of an ‘Aparajita Task Force’ at the district level to handle cases of rape and atrocities against women and children. This task force will be led by a deputy superintendent of police.

  1. Restrictions on Media Reporting

The Aparajita Woman and Child Bill 2024 includes provisions to penalize the publication of any matter related to court proceedings in rape cases without permission.

Legal and Political Considerations

Legal experts have noted that while the bill is constitutionally valid, it will require presidential assent to become law. This is because the bill prescribes punishments that differ from those in the central laws, specifically the Bharatiya Nyaya Sanhita (BNS) and Bharatiya Nagarik Suraksha Sanhita (BNSS). Under Article 254(2) of the Constitution, a state law that contradicts central law on a concurrent list matter must receive presidential approval to take effect within the state.

Historical Precedents

Similar bills passed by other states, such as Andhra Pradesh’s Disha Bill (2019) and Maharashtra’s Shakti Bill (2020), which also mandated the death penalty for rape, have not yet received presidential assent.

With the ruling Trinamool Congress holding a significant majority in the West Bengal Assembly (223 out of 294 seats), the passage of the Aparajita Bill was smooth. However, the bill’s implementation will hinge on receiving approval from both the state governor and the President of India. The BJP’s stance during the voting remains uncertain, though the party has previously expressed support for strict punishments for rapists.

Impact and Future Prospects

The Aparajita Bill represents a bold move by the West Bengal government to address the rising concerns about sexual violence in the state. If it receives the necessary approvals, it could set a precedent for other states looking to implement similar measures.

The Aparajita Woman and Child Bill 2024’s focus on swift justice and enhanced penalties reflects the government’s commitment to protecting vulnerable populations, but its ultimate success will depend on effective enforcement and the resolution of any constitutional challenges.
