Former South Korean President Yoon Suk Yeol has been rearrested in connection with last year’s failed attempt to impose martial law, an action that led to his impeachment and a national political crisis. The arrest was made following a hearing at the Seoul Central District Court on Wednesday, where a judge issued the warrant citing concerns that Yoon could destroy evidence.
Yoon, who became the first sitting president in South Korea to be arrested, now faces trial on charges of leading an insurrection. His martial law order in December 2023 lasted six hours and bypassed standard cabinet procedures.
Charges Include Abuse of Power and Provocation Strategy
During the seven-hour hearing, a special counsel team laid out five major charges against Yoon, including violating the rights of cabinet members by excluding some from the meeting where martial law was declared.
Prosecutors also allege that Yoon ordered drones to be flown over North Korea to provoke a military response that could justify his declaration of emergency rule. If convicted, Yoon could face a life sentence or even the death penalty.
The former president initially attended the hearing with legal counsel to deny the allegations but was taken to Seoul Detention Center pending further proceedings.
Yoon was first arrested in January after a standoff with law enforcement, during which officials cut through barricades and barbed wire to detain him. That arrest was later overturned on technical grounds, but the trial continued.
Several of Yoon’s senior aides also face charges of insurrection and abuse of authority related to the failed martial law order. Since Yoon is no longer in office, he no longer benefits from presidential immunity from criminal prosecution.
New President Vows Democratic Reforms Post-Crisis
South Korea’s new president, Lee Jae-myung, elected in June following a snap election, had campaigned on restoring democratic norms and accountability. Upon taking office, he appointed a special counsel team to investigate Yoon’s actions, including the martial law declaration and other allegations from his administration.
